Clear rules for platform use, user responsibility, and AirWave enforcement rights.
These Terms are written to protect both AirWave and the people who use it. They explain what users are responsible for, what AirWave may do to protect the platform, how user data is stored and used, and the limits of our liability where events outside our reasonable control affect the service.
1. Acceptance Of Terms
By accessing or using AirWave, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the service.
AirWave is operated by Mesesilia Labs. These Terms apply to our website, player, accounts, profiles, subscriptions, and related features.
2. Eligibility And Accounts
You are responsible for the accuracy of the information you submit, the security of your account credentials, and any activity that occurs through your account.
You must not impersonate another person, create misleading profiles, or use AirWave in a way that violates applicable law or the rights of others.
3. User Conduct And Responsibility
You are solely responsible for your conduct, profile content, messages, uploaded images, links, and any use of AirWave made through your account.
You may not use AirWave to harass, abuse, defraud, infringe intellectual property rights, spread unlawful or harmful content, interfere with the platform, scrape the service, reverse engineer protected features, or attempt unauthorized access to our systems or other users’ data.
4. AirWave Enforcement Rights
To protect the service, users, and our business, AirWave may in its sole discretion investigate conduct, remove or restrict content, warn users, limit features, cancel or refuse subscriptions, suspend accounts, terminate accounts, block access, or report conduct to relevant authorities where appropriate.
We may take these actions with or without prior notice where reasonably necessary for security, abuse prevention, legal compliance, platform integrity, payment risk, or user protection.
5. AI, News, And Broadcast Content
AirWave uses third-party data sources, automation, and AI-generated scripts, summaries, translations, and audio experiences. While we aim for relevance and quality, content may be incomplete, delayed, unavailable, or inaccurate.
AirWave is not a substitute for professional advice, emergency information, or official reporting. You are responsible for independently verifying critical information through original or official sources.
6. User Data, Storage, And Privacy
By using AirWave, you authorize us to collect, process, and store the data reasonably required to operate, secure, personalize, improve, and support the service, including account information, profile details, preferences, usage data, listening history, and feedback signals, in accordance with our Privacy Policy.
We use commercially reasonable safeguards to protect stored data, but no online service, network, cloud environment, or database can guarantee absolute security. You acknowledge and accept the inherent risks of internet-based services and electronic storage.
7. Cybersecurity, Service Risks, And Force Majeure
AirWave is not liable for delay, failure, interruption, loss, corruption, unavailability, or security incidents caused in whole or in part by events beyond our reasonable control, including cyberattacks, distributed denial-of-service attacks, malware, unauthorized intrusions, zero-day exploits, telecommunications failures, cloud provider failures, labor disputes, natural disasters, war, civil unrest, governmental action, or other force majeure events.
If a security incident occurs, we may take urgent protective measures such as disabling features, rotating credentials, forcing logouts, suspending integrations, or temporarily limiting service access.
8. Subscriptions, Billing, And Feature Access
Paid features are billed through Stripe or another designated payment provider. Subscription access, limits, and features may vary by plan and may change over time.
Each plan includes a daily broadcast cap, a maximum number of stories per broadcast, and a defined voice quality tier (standard neural, expressive Flash, or premium v3). Daily caps reset at midnight in your local time zone. Once a daily cap is reached, additional broadcasts are unavailable until the next reset, or you may upgrade to a higher plan for an increased cap.
Caps and tiers are enforced server-side and are part of the agreed service. We may adjust caps, story counts, voice tiers, or feature gates with reasonable notice, including changes intended to keep service costs sustainable. Where law requires, material changes will be communicated before they take effect, and you will have the opportunity to cancel.
Family plans include multiple seats under a single billing relationship; usage caps apply per seat. Seat assignment, invitation, and removal are managed by the primary account holder.
You are responsible for valid payment details and applicable taxes. We may suspend, downgrade, or cancel paid access if payment fails, is reversed, is disputed, or appears fraudulent. Abuse of automated request patterns, attempts to bypass the daily cap, account-sharing across non-Family plans, or use of the service to redistribute synthesized audio commercially without permission may result in suspension or cancellation.
9. Disclaimers And Limitation Of Liability
AirWave is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We disclaim warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the maximum extent permitted by law, AirWave, Mesesilia Labs, and our affiliates, officers, employees, contractors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, or opportunity arising out of or related to your use of the service.
10. Your Rights And Contact
Nothing in these Terms limits rights that cannot be waived under applicable law. Where required by law, we will provide notice, explanation, or appeal opportunities for certain enforcement actions.
